German court orders Foreign Ministry to expedite visa issuance for Afghan citizens

The court has given the Foreign Ministry until Wednesday to report on the actions taken in this regard; otherwise, a fine will be imposed.


According to the newspaper Welt, so far, 20 similar emergency rulings have been issued by this court, stating that the German government is obligated to issue visas due to legal commitments arising from valid acceptance promises.


One of the plaintiffs is a university law professor who, along with 13 family members, has been waiting for a German visa in Pakistan for months. The Foreign Ministry’s attempts to postpone these rulings through the Berlin Administrative High Court have been rejected in at least one case.


The German federal government’s acceptance program, which began in October 2022, was designed to support Afghan citizens whose lives or those of their families are at risk; however, it was halted this spring by Alexander Dobrindt, Germany’s new Interior Minister.


Currently, over two thousand Afghan citizens with acceptance promises are residing in Pakistan, where their residence visas have expired, putting them at risk of detention and deportation. In recent weeks, Pakistani police have inspected several guesthouses financially supported by Germany and detained around 400 Afghan citizens without visas. Half of these individuals have been deported, while the others were temporarily released following intervention by the German government.


Pakistan has repeatedly asked Berlin to clarify the status of these individuals; however, despite the pressure, their transfer from Islamabad to Germany has been completely halted over the past four months. Now, German court rulings may compel the Foreign Ministry to fulfill its legal obligations and issue visas.

The German Administrative Court has warned that if the country's Foreign Ministry delays the visa issuance process for Afghan citizens who were previously promised relocation and acceptance, it will face financial penalties.
